Child Support & SSDI

I recently was determined to be disabled. I will start receiving my checks soon. I just received a letter from SSA stating they would be taking child support out of my checks. I live in PA. Is there anyway around this? I was under the assumption from other people they would not consider my SSDI as part of my income.

I guess you could consult a lawyer who has expertise in disability and family law.

My understanding is that SSDI does count toward your total income. I say this because I have to pay taxes on SSDI that pushes our total family income above a certain amount.

But I don't know a lick about child support.

Are you receiving SSI instead of SSDI? SSI is income-based, and they can lower your benefits based on your income. So they can force you to do things like spend down any savings, lower your monthly benefit amount, etc.

If you are getting SSDI, contact the SSA's 1-800 number and ask them for the statute in their book (I can't remember, I think it's the red book) that allows them to take out the funds. Then go online to SSA.gov and read the book online and see what the law states.

You could also try contacting a local attorney specializing in disability cases to ask them. Often, the staff knows questions such as this and can answer them for you for free.
